Internet Archive ("The CDL Case") 📚 The United States Court of Appeals for the Second Circuit determined that the Internet Archive's (IA) digital loaning program, called “Open Libraries,” was not a fair use.
The court found that the program violated the copyrights of several major book publishers. IA's Open Libraires system had utilized their own variety of controlled digital lending (CDL) to make their collections available for digital loans. After this decision,
